Guardianship of an AdultIf an adult is unable to make effective decisions about his or her personal care, health, and safety due to a clinically diagnosed condition, the Massachusetts Court can appoint a Guardian for the adult. The Guardian preserves the adult’s self-reliance and independence, and makes personal decisions on the adult’s behalf. |

Guardianship of a MinorIf parents are unable to care for a child, the Massachusetts Court can give a Guardian custody of the child and the responsibility to take care of the child. The Guardian provides a stable home and makes decisions about the child’s everyday care, education, health and safety. |

Conservatorship of an Adult and of a MinorIf an adult is unable to make effective decisions about his or her money, property or business affairs due to a clinically diagnosed condition, or, if a minor lacks the protection of an adult to manage his or her estate, the Massachusetts Court can appoint a Conservator. A Conservator makes financial decisions and manages the assets and property of an disabled adult or a minor. Generally the court forms and procedures for becoming a Conservator are the same whether filing a Petition for Conservatorship for a disabled adult or a minor. |
